# DMCA Policy

Club respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). This policy outlines how we process copyright infringement notices and how strikes are issued

## **Overview**

We take copyright infringement seriously. Club uses a progressive strike system to address confirmed violations of copyright law.

## **Strike System**

#### **First Strike**

**Action:** A strike is recorded in our internal systems. **Notification:** The creator receives a notice explaining the violation, guidance on compliance, and instructions on how to submit a counter-notification.

#### **Second Strike**

**Action:** A second strike is recorded in our systems. **Additional Measures:** The creator’s account is placed under enhanced monitoring. **Notification:** The creator receives a second warning with details of the violation and counter-notification instructions.

#### **Third Strike**

**Action:** A final strike is recorded. **Additional Measures:** The account is permanently banned due to repeated infringement. **Notification:** The creator receives a final notice outlining the enforcement action and their options.

## **Strike Expiration**

DMCA strikes expire after a period of **6 months**, provided that no additional copyright violations occur during that time.

Once a strike expires, it is removed from the creator’s record for the purposes of determining progressive penalties. Expired strikes do not count toward account suspension or termination.

## **DMCA Process**

#### **1. Notice Receipt**

We review all DMCA takedown notices for completeness and validity.

#### **2. Content Review**

Allegedly infringing content is evaluated against the submitted notice.

#### **3. Action Implementation**

If a violation is confirmed:

* The infringing content is removed
* A strike is applied to the account (when applicable)

#### **4. Creator Notification**

The account holder is informed of:

* The content that was removed
* The reason for removal
* Any resulting penalties
* Instructions on how to submit a counter-notification

#### **5. Content Removal**

Confirmed infringing content is removed from the platform.

## **Counter-Notification Process**

Creators who believe their content was removed in error may submit a counter-notification in accordance with DMCA requirements.

Valid counter-notifications will be reviewed, and content may be restored when legally appropriate.
